I get a call from a fake process server-Update~Rachel Holbert-Jones Page, Sunset SC
Update: After the initial call from this so-called process server leaving a phone number to a supposed law office in Texas, but the phone number he called from appeared to come from a courthouse in North Carolina, where we are involved in litigation, he called again the very next day asking for someone named Melvin something (can't remember the last name now) and from the same courthouse phone number. I googled the name of the person he was asking for, it was a unique name and a dead man from Arkansas popped up. A man they called the broom man.
This was without a doubt a bogus process server that was nothing more than a scammer. What is odd is that it came from a courthouse where we are involved in litigation and Arkansas is where my ex boyfriend (came up in the litigation, more info on him in My Story, at the bottom of this post) lives or used to. I assume he still lives there, if living in an RV can be classified as living in a particular city/town. I thought this was odd.
I thought about calling the Texas number and telling them good luck with serving the broom man of Arkansas since he's dead. I did a google search and quite easily found the broom man. There were several news stories written about him in Little Rock, Arkansas which is another oddity because my ex boyfriend spent most of his time in Little Rock when he wasn't in Tennessee or traveling elsewhere. I'm not sure where or how they found the broom man or perhaps they were referring to someone else but it's odd that is where my ex boyfriend spent most of his time and I'm not even sure where they got that information. I know they (opposing counsel) asked about my ex boyfriend in my deposition but I can't remember if I told them he spent most of his time in Little Rock or perhaps I posted it on one of my blogs. It may have been in the police report I filed when my laptop, devices and other personal information was stolen but that wasn't in Arkansas. I don't know. Melvin Pickens of Little Rock, Arkansas sold brooms for the blind for over thirty years. He was also featured on CBS, On The Road with Steve Hartman, was a cancer survivor, that was eventually confined to his apartment. He died in 2017 and his grandson opened a gofundme account to raise money to pay some debts and put Mr. Pickens to rest.
Another small update: I also have a pretty good idea how he (when I say he, I'm referring to the man we're fighting in court) found the broom man. I curiously typed in my ex boyfriend's name and Little Rock in the google search bar and up popped a man by the same name that died back in 2017, the same year Mr. Pickens died and in the same newspaper. I'm not sure how he made the leap and found the broom man's name but somehow he did. My husband says, the man we're fighting probably spends all of his spare time online which may be true.
This post turned out to be much longer than I intended and I really think the broom man deserves his own post since I included several links and I can always link back to this post in my next one.
Here are some links to articles about fake process servers and what to look out for. One thing is certain, in my case, they spoofed the courthouse phone number. The clerk at the court assured me process servers don't use their phones because they don't allow it and there was no case/summons for me at this courthouse or any court in the surrounding counties. It was a scam, plain and simple. They may also spoof a sheriff's department phone number too which can be quite scary for someone who doesn't know. The police nor the sheriff call to serve you. They come to your residence. And they won't leave papers with your child and doubtfully will leave the summons with anyone other than you. This is what happened to me and it was most definitely fake. I did not get the call, it went to my voicemail and the "process server" left me a voicemail message then called the next day after I called the Texas phone number he left me and told whoever it was (in a voicemail message) that serving me over the phone was improper service in North Carolina. The next day I received the call asking for the broom man who's dead. This is partly why we think it might be the man we are fighting in court. Either way, it was fake and I've provided a few links to articles to better equip you should you receive a call from one of these so-called servers.
This isn't the first time I've been targeted by scammers. Several years ago I was targeted by a romance scammer but fortunately figured out that was what it was relatively quickly and knew for sure when he asked for $4000 for his fake daughter's surgery or something. Unfortunately, a lot of women did fall for these scams. I googled the photos he was using and it turned out to be photos from a Ukrainian journalists facebook page. This sick scammer even used the journalists daughter's pictures in his scam. It wasn't too long later the journalist removed access to his family's photos. That's pretty sick in my opinion but the scammers are using someone's children's photos. I reported him and even wrote several posts about it.

Yesterday, I received a call from a "Process Server." Whether this man was real is unknown. He left a voicemail message that I listened to last night. It appeared to come from my local courthouse but when I called the courthouse this morning, I found out there was no pending case other than the litigation I'm currently involved in. He said he would come by my home (I no longer have a home here and the only home he could be referring to in this local area would be my ex husband's and he was evicted a few months ago) so I'm not sure where he was going. I thought the message sounded a little odd because he never named my county of residence, he only referred to my county of residence as the place where the legal action is purportedly at and I thought this was strange in that he would have at least named the county where the complaint was filed. He even went on to say that if I weren't there (not sure where "there" is) between 6 and 7 PM I would be considered non-responsive and the case would proceed without me and that I'd been informed. No state that I'm aware of allows service through voicemail. North Carolina certainly does not. Even more strange was the phone number he provided was in Texas. I did call it out of curiosity and reached the voicemail of a man who identified himself but not whether he was an attorney or perhaps the process server company ("Mr. Clemmons") worked for. But why would an attorney or process server in Texas be handling a lawsuit when I live in North Carolina?
I checked my local courthouse where I live in the Outer Banks, the local courthouse where I'm involved in the other litigation, my aunt's in West Virginia because I spend a great deal of time there caring for her and even checked a few surrounding counties to see if perhaps the case was filed there to no avail. I could find no case anywhere. If there is a case filed in some other state I don't live in, well, I'm unaware of it and will continue to be unaware of it because I'm not calling every county clerk's office in North Carolina and I'm certainly not calling courthouses in other states trying to locate this litigation.
I can only conclude this call from a "Process Server" was a fake and if it's not they're going to have to file the case. And the complaint and summons comes before the documents for the process server to file.
My ex husband, who is also named in the current litigation, thinks it might be from the person we're involved in this litigation with trying to extract information. I don't honestly know and I'm so busy with the appeal I don't have time to spend any more time thinking about it.
